Throughout the site, the terms “we”, “us” and “our” refer to Rene Ruiz Collection. Rene Ruiz Collection offers this website, including all information, tools and Services available from this site to you, the user, conditioned upon your acceptance of all terms, conditions, policies and notices stated here.
By visiting our site and/or purchasing something from us, you engage in our “Service” and agree to be bound by the following terms and conditions (“Terms of Service”, “Terms”), including those additional terms and conditions and policies referenced herein and/or available by hyperlink. Our online store is hosted on Shopify Inc. They provide us with the online e-commerce platform that allows us to sell our products and Services to you.

Rene Ruiz Collection reserves the right to modify the prices of its products at any time. Users are responsible for checking the prices of products before making a purchase. We reserve the right at any time to modify or discontinue the Service (or any part or content thereof) without notice at any time.
We shall not be liable to you or to any third-party for any modification, price change, suspension or discontinuance of the Service.
SECTION 5 - PRODUCTS OR SERVICES (if applicable)
Certain products or Services may be available exclusively online through the website. These products or services may have limited quantities and are also subject to the Returns and Refunds (Domestic & international), Black Friday Cyber monday Sale, Order Cancellations, Store Credits outlines in Section 6 below. We have made every effort to display as accurately as possible the colors and images of our products that appear at the store. We cannot guarantee that your computer monitor's display of any color will be accurate. We reserve the right, but are not obligated, to limit the sales of our products or Services to any person, geographic region or jurisdiction. We may exercise this right on a case-by-case basis. We reserve the right to limit the quantities of any products or Services that we offer. All descriptions of products or product pricing are subject to change at any time without notice, at the sole discretion of us. We reserve the right to discontinue any product at any time. Any offer for any product or Service made on this site is void where prohibited.
We do not warrant that the quality of any products, Services, information, or other material purchased or obtained by you will meet your expectations, or that any errors in the Service will be corrected.

SHIPPING TIME FRAMES
IN-STOCK: In-stock items purchased through reneruizcollection.com will be shipped out within 5
to 7 business days after the order is placed.
MADE TO ORDER: Made to order items purchased through reneruizcollection.com will be
shipped out within 4 to 6 weeks after the order is placed.
RETURN AND REFUND POLICY
* ONLINE DOMESTIC USA PURCHASES ONLY *
· Rene Ruiz Collection’s Return and Refund Policy for online domestic purchases is as
follows:
o Any items (including made-to-order styles) purchased
through reneruizcollection.com EXCEPT THOSE IN THE SALE SECTION, may be returned
or exchanged within 15 business days of your orders delivery date.
o The item should be unworn and in new condition with all the original tags
attached.
o A $200 restocking flat fee will be imposed on returns of 4 items or more within a
single order.
o We will provide you with a return label, and a $15 fee will be deducted from
your final refund for shipping, plus a 3% restocking fee.
o Any expedited shipping charges paid are non-refundable
o Please note that if you do not use our return label, Rene Ruiz Collection is not
responsible for packages that are lost, stolen, or damaged during transit.
o Do not send back any items without first creating your return/exchange through
our contact center.
o Items shipped back to us without our return label will not be processed.
o Please allow up to 15 business days from the time your return arrives at our
facility for ourteam to inspect, process, update you on your return, and process
any refunds. We will update you via email.
o Without exception, we will not offer refunds for garments that come back with
missing tags, deodorant marks, alterations, rips, scuffs, or any other sign of use.
o SALE items are not eligible for return, only store credit or exchange.
International orders are NOT Returnable or Refundable – ALL SALES ARE CONSIDERED FINAL.
Orders that are cancelled after 24 hours are subject to an Order Cancellation Charge as follows:
in stock item cancelled after 24 hours will incur a $25.00 order cancellation fee per item and
made-to-order item cancelled after 24 hours will incur a $100.00 order cancellation fee per
item.
Store Credits will be sent to your email within 7 business days after your return is delivered to
our warehouse. Your store credit is only valid on our website www.ReneRuizCollection.com or
in company owned brick and mortar locations listed on our website. Store credits It is only valid
for IN STOCK CLOTHING (cocktail dresses, evening gowns, jump suits, etc.) and is not valid for
made-to-order or accessories. Your store credit NEVER expires. Store Credits have NO Cash
Value. If you purchase something MORE expensive than your store credit and use both a credit
card and store credit for your purchase and return the item, your refund (minus the
$15.00 shipping fee +3% processing fee) will be issued to the same forms of payments in which
you paid, meaning a credit to your credit card (minus the $15.00 shipping fee +3%
processing fee), and an additional credit to your store credit. If you purchase something LESS
expensive than your store credit and return the item, your refund (minus the $15.00 shipping
fee +3% processing fee) will be issued in the form of a store credit.

SECTION 7 - ACCURACY OF BILLING; ACCOUNT INFORMATION; PAYMENT TERMS; CREDIT CARD CHARGEBACKS
Rene Ruiz Collection reserves the right to refuse to process any order for any reason. We may, in our sole discretion, limit or cancel quantities purchased per person, per household or per order. These restrictions may include orders placed by or under the same customer account, the same credit card, and/or orders that use the same billing and/or shipping address. In the event that we make a change to or cancel an order, we may attempt to notify you by contacting the e-mail and/or billing address/phone number provided at the time the order was made. We reserve the right to limit or prohibit orders that, in our sole judgment, appear to be placed by dealers, resellers or distributors.
You agree to provide current, complete and accurate purchase and account information for all purchases made at our store. You agree to promptly update your account and other information, including your email address and credit card numbers and expiration dates, so that we can complete your transactions and contact you as needed.
You acknowledge and agree that that you will pay Rene Ruiz Collection all amounts due in full at delivery of merchandise for in-store transactions and at the time of placing an order for online store transactions. Overdue accounts shall bear interest at one and one-half percent (1 1/2%) per month, or at the highest rate permissible by law, whichever is higher.
If you initiate a credit card account chargeback against Rene Ruiz Collection for any reason, you agree that, regardless of the decision of the credit card bank, you shall be liable to Rene Ruiz Collection for the full cost of your purchase, any damages incurred by Rene Ruiz Collection, and attorney’s fees and costs incurred to collect the same against you.
You agree that you are bound to these Terms of Service together with the terms of Rene Ruiz Collection’s Refund Policy and that you shall not attempt to circumvent the same by initiating a credit card account chargeback against Rene Ruiz Collection. Prior to initiating a credit card account chargeback, you agree to email brad@reneruizcollection.com to notify Rene Ruiz Collection in writing of your intent to initiate a credit card account chargeback and give Rene Ruiz Collection two (2) business days from the date of such written notice to cure the dispute giving rise to your intention to initiate the chargeback prior to initiating the chargeback. Rene Ruiz Collection will make all commercially reasonable attempts to resolve any dispute you may have with us about your transaction with us. You acknowledge that unwarranted credit card chargebacks cause irreparable harm to Rene Ruiz Collection, including, without limitation, increases in merchant account fees, increases in merchant account reserves, and denial of applications for new merchant accounts. The Parties acknowledge and agree that in the event of a breach of this provision of these Terms of Service, the actual damages incurred by Rene Ruiz Collection may be difficult or impossible to ascertain. Therefore, the Parties agree that a reasonable estimate of the damages is set forth below. For each credit card chargeback that you: (a) initiate without giving Rene Ruiz Collection written notice of the same and/or without giving Rene Ruiz Collection two (2) business days from the date of such written notice to cure the dispute giving rise to your intention to initiate the chargeback prior to initiating the chargeback, regardless of the outcome of the chargeback request; (b) lose; or (3) for each credit card chargeback that you initiate and win but which chargeback request is not consistent with our Refund Policy, you agree to pay liquidate damages in the amount of $10,000.00 to Rene Ruiz Collection. The Parties acknowledge that this amount is not a penalty but rather an estimate of the damages that would be incurred due to such a breach. The payment of such liquidated damages does not constitute a waiver of any other rights or remedies available to Rene Ruiz Collection pursuant to these Terms of Service or applicable law.
Your initiation of a credit card account chargeback against Rene Ruiz Collection for any reason shall constitute a violation of the non-disparagement provisions of Section 15 of these Terms of Service below.
SECTION 8 - OPTIONAL TOOLS
We may provide you with access to third-party tools over which we neither monitor nor have any control nor input. You acknowledge and agree that we provide access to such tools ”as is” and “as available” without any warranties, representations or conditions of any kind and without any endorsement. We shall have no liability whatsoever arising from or relating to your use of optional third-party tools.
Any use by you of the optional tools offered through the site is entirely at your own risk and discretion and you should ensure that you are familiar with and approve of the terms on which tools are provided by the relevant third-party provider(s). We may also, in the future, offer new Services and/or features through the website (including the release of new tools and resources). Such new features and/or Services shall also be subject to these Terms of Service.

SECTION 16 - NON-DISPARAGEMENT.
Neither Rene Ruiz Collection nor you shall make anv oral or written statement, including, without limitation, on any social media platform and/or google reviews, about the other party, without regard to the accuracy or truth of such statement, which is intended or reasonably likely to disparage, demean, or embarrass the other party or otherwise degrade the other party's reputation in the apparel, business, and/or legal communities (collectively, “Disparagement”).
You acknowledge that Disparagement, without regard to the accuracy or truth of the Disparagement, causes irreparable harm to Rene Ruiz Collection, including, without limitation, reputational harm, diminished value of good will, decrease in revenue, and lost profits. The Parties acknowledge and agree that in the event you engage in any Disparagement of Rene Ruiz Collection, the actual damages incurred by Rene Ruiz Collection may be difficult or impossible to ascertain. Therefore, the Parties agree that a reasonable estimate of the damages is set forth below. For each individual instance in which you engage in Disparagement of Rene Ruiz Collection, you agree to pay liquidate damages in the amount of $10,000.00 to Rene Ruiz Collection. The Parties acknowledge that this amount is not a penalty but rather an estimate of the damages that would be incurred due to such a breach. The payment of such liquidated damages does not constitute a waiver of any other rights or remedies available to Rene Ruiz Collection pursuant to these Terms of Service or applicable law.
SECTION 17 - SEVERABILITY
In the event that any provision of these Terms of Service is determined to be unlawful, void or unenforceable, such provision shall nonetheless be enforceable to the fullest extent permitted by applicable law, and the unenforceable portion shall be deemed to be severed from these Terms of Service, such determination shall not affect the validity and enforceability of any other remaining provisions.
SECTION 18 - TERMINATION
The obligations and liabilities of the parties incurred prior to the termination date shall survive the termination of this agreement for all purposes. These Terms of Service are effective unless and until terminated by either you or us. You may terminate these Terms of Service at any time by notifying us that you no longer wish to use our Services, or when you cease using our site. If in our sole judgment you fail, or we suspect that you have failed, to comply with any term or provision of these Terms of Service, we also may terminate this agreement at any time without notice and you will remain liable for all amounts due up to and including the date of termination; and/or accordingly may deny you access to our Services (or any part thereof).
SECTION 19 - ENTIRE AGREEMENT
The failure of us to exercise or enforce any right or provision of these Terms of Service shall not constitute a waiver of such right or provision. These Terms of Service and any policies or operating rules posted by us on this site or in respect to the Service constitutes the entire agreement and understanding between you and us and governs your use of the Service, superseding any prior or contemporaneous agreements, communications and proposals, whether oral or written, between you and us (including, but not limited to, any prior versions of the Terms of Service). SECTION 20 - GOVERNING LAW; VENUE: ATTORNEY’S FEES AND COSTS
These Terms of Service and any separate agreements whereby we provide you Services shall be governed by and construed in accordance with the laws of the State of Florida. The Parties agree that the exclusive venue for any and all legal action between the Parties shall be the applicable state courts in Miami-Dade County, Florida. In any legal action between the Parties relating to any matter, including, without limitation, any disputes arising out of the provision of our Service to you, purchase of any of our merchandise by you, and/or in connection with these Terms of Service and any separate agreements whereby we provide you Services, the Court shall award attorney’s fees and costs to the prevailing party for all levels of litigation, including pre-suit, lawsuit, trial, and all appeals, including for litigating the appropriate amount of any such attorney’s fees and costs award.
